Equinox Technology Acceptable Use Policy (AUP)
Purpose
This Acceptable Use Policy (“Policy”) defines acceptable and prohibited uses of Equinox Technology’s telecommunications, internet, and managed network services (“Services”).
The Policy protects our customers, partners, and network integrity while ensuring compliance with applicable laws and carrier regulations.
By using Equinox Technology Services, Customer agrees to abide by this Policy and all incorporated agreements, including the Fair Use Policy, Service Level Agreement, and Terms and Conditions available at https://www.equinoxtechnology.net/legal.
Scope
This Policy applies to all users of Equinox Technology Services, including employees, agents, contractors, and anyone accessing the network or systems under Customer’s account.
It governs all Services, including but not limited to UCaaS, internet connectivity (dedicated and broadband), SD-WAN, POTS replacement, managed routers, and related data or voice products.
General Principle
Equinox Technology provides its Services for legitimate, lawful business use.
Use that disrupts or degrades network performance, interferes with other users, or violates law or regulation is strictly prohibited.
Customers are responsible for ensuring that all use of their account — by employees, affiliates, or third parties — complies with this Policy.
Prohibited Uses
A. Illegal, Harmful, or Fraudulent Activity
Customers may not use Equinox Technology Services to:

Violate any applicable federal, state, or local law or regulation.

Engage in fraud, theft, or identity misrepresentation.

Transmit, distribute, or store illegal material, including content that violates intellectual property or privacy rights.

Facilitate or conceal criminal activity.
B. Network and System Abuse
Prohibited activities include (but are not limited to):

Gaining unauthorized access to networks, systems, or data (hacking).
-
Probing, scanning, or testing the vulnerability of any system or network.
-
Circumventing user authentication or security mechanisms.
-
Interfering with or disrupting other network users, servers, or equipment.
-
Using the Services to deliver malware, viruses, or denial-of-service (DoS) attacks.
C. Messaging and Calling Abuses

Sending unsolicited bulk messages (spam), including via SMS, MMS, fax, or email.

Spoofing, falsifying caller ID, or misrepresenting identity.

Engaging in autodialing, predictive dialing, or robocalling not compliant with the Telephone Consumer Protection Act (TCPA) or 10DLC registration requirements.

Generating high-volume short-duration calls (“traffic pumping”) or toll fraud.

Using Services for harassment, threatening communications, or obscene content.
D. Resale or Unauthorized Sharing

Reselling or redistributing Equinox Technology Services without written authorization.

Using business plans for carrier bypass, call bridging, or trunk aggregation.

Permitting third parties to use Services for unrelated business activity.
Security Responsibilities
Customers must take reasonable steps to protect their own systems and credentials.
This includes maintaining updated firewalls, passwords, and endpoint protection, and immediately reporting any suspected compromise or misuse to Equinox Technology at security@equinoxtechnology.net.
Equinox may implement network-level safeguards or temporary suspensions to protect Customers and the broader network if abnormal or malicious activity is detected.
Enforcement
Violations of this Policy may result in one or more of the following actions:

Written notice and request for corrective action.

Temporary service suspension or traffic filtering.
-
Additional charges for excessive use or carrier penalties.
-
Termination of Services for repeated or severe violations.
-
Reporting to law enforcement or regulatory authorities when required by law.
Equinox Technology reserves the right to determine, in its reasonable discretion, whether any activity constitutes a violation of this Policy.
Legal Compliance
Customers are responsible for complying with all applicable laws and regulations, including:

FCC regulations,
-
Telephone Consumer Protection Act (TCPA), and
-
10DLC and toll-free messaging registration rules.
Non-compliance may result in carrier penalties or service termination.
Changes to This Policy
Equinox Technology may revise this Policy periodically to reflect legal, regulatory, or technical changes.
Updates become effective upon posting to this page, and Customers will be notified of material changes via email or invoice notice.
